Terms of Service
Effective date: July 11, 2026. These terms are intentionally strict to protect PicSKU before adding paid credits, checkout, and commercial image workflows.
1. Acceptance of Terms
These Terms of Service govern your access to and use of PicSKU, including image generation, editing tools, asset storage, credits, support, and paid features. By using PicSKU, you agree to these terms.
If you use PicSKU for a company, marketplace store, agency, or client, you represent that you have authority to bind that organization and that the organization is responsible for your activity.
2. Accounts and Eligibility
You must provide accurate account information, keep your email account secure, and promptly notify us of unauthorized access. You are responsible for all activity under your account.
We may suspend, throttle, restrict, or terminate accounts that appear abusive, fraudulent, unlawful, risky, inactive, or inconsistent with these terms.
3. Credits, Payments, and Refunds
Credits are a limited, revocable license to request eligible PicSKU operations. Credits are not money, stored value, gift cards, or transferable property unless expressly required by law.
Prices, included features, expiration rules, generation costs, and credit packages may change at any time before purchase. Taxes, payment fees, currency conversion, and processor rules may apply.
All purchases are final except where required by law or expressly approved by PicSKU. Failed generations, partial outputs, processing delays, or user dissatisfaction do not automatically create refund rights.
We may withhold credits, reverse credits, disable outputs, or close access where payment fails, chargebacks occur, fraud is suspected, or usage violates these terms.
4. Uploaded Content
You retain ownership of content you upload, subject to the license you grant us to host, copy, process, transform, display, transmit, and store it as needed to provide and improve PicSKU.
You represent that you have all rights, permissions, releases, and licenses needed for uploaded content, prompts, trademarks, products, packaging, people, locations, and brand assets.
You must not upload illegal content, sexual content involving minors, non-consensual intimate content, regulated personal data, biometric identifiers, government IDs, payment cards, malware, infringing material, or content designed to deceive or harm others.
5. Generated Outputs
Subject to your compliance with these terms and payment obligations, PicSKU assigns to you any rights we may have in generated outputs. You are solely responsible for reviewing outputs before publication or commercial use.
We do not guarantee that outputs are unique, accurate, platform-compliant, non-infringing, suitable for regulated advertising, or accepted by any marketplace, payment provider, ad network, or consumer-protection authority.
You must not use outputs to misrepresent a product, fake endorsements, fabricate certifications, imply unavailable features, impersonate people, violate marketplace rules, or create deceptive advertising.
6. Prohibited Conduct
You may not reverse engineer the service, scrape private endpoints, bypass rate limits, resell account access, automate abusive traffic, interfere with infrastructure, probe security controls, or use PicSKU to develop a competing model or service.
You may not remove watermarks or provenance indicators where present, obscure legally required disclosures, abuse support channels, submit false disputes, or use PicSKU in a way that creates legal, safety, operational, or reputational risk.
7. Service Availability
PicSKU may change, pause, discontinue, limit, or price any feature at any time. AI generation may fail, produce unexpected results, take longer than estimated, or be unavailable due to provider, network, safety, capacity, billing, or maintenance issues.
We may delete or restrict assets, jobs, accounts, or outputs to protect users, vendors, payment processors, marketplaces, rights holders, or PicSKU.
8. Intellectual Property
PicSKU, including its software, workflows, interface, templates, prompts, branding, documentation, and underlying systems, is owned by PicSKU or its licensors. Except for your permitted use of the service, no rights are granted to PicSKU intellectual property.
Feedback, suggestions, and ideas may be used by PicSKU without restriction or compensation.
9. Disclaimers and Liability Limits
PicSKU is provided as is and as available. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, uptime, and uninterrupted operation.
To the fullest extent permitted by law, PicSKU will not be liable for indirect, incidental, special, consequential, exemplary, punitive, lost-profit, lost-revenue, lost-data, or business-interruption damages.
To the fullest extent permitted by law, PicSKU's total liability for all claims is limited to the greater of the amount you paid to PicSKU in the three months before the event giving rise to the claim or USD 50.
10. Indemnity, Termination, and Changes
You will defend, indemnify, and hold harmless PicSKU from claims, losses, liabilities, damages, costs, and expenses arising from your uploads, prompts, outputs, commercial use, breach of these terms, or violation of law or third-party rights.
We may update these terms at any time. Continued use of PicSKU after updated terms become effective means you accept the updated terms.
Sections that by nature should survive termination will survive, including payment obligations, ownership provisions, disclaimers, liability limits, indemnity, and dispute-related provisions.
